Privacy and Data

This John Deere Enterprise Privacy Statement (“Statement”) is issued on behalf of the entities listed below as ‘Data Controllers’ in the table at the end of this Statement (each, individually, “John Deere”, “we” or “us”).  This Statement is addressed to individuals with whom we interact, including visitors or users of our websites, applications (web or mobile), or online services (“Online Services”); current and prospective customers; management and personnel of corporate customers and vendors; management and personnel of authorized John Deere dealerships; visitors to our facilities, museums and attractions; and other recipients of our services.  We refer to individuals whose Personal Data is processed as ‘you’ in this Statement.  

John Deere in its role as data controller will process information about you in paper and electronic format referred to as “Personal Data”.  Personal Data will be collected directly from you, we will collect such data internally, and in certain cases, we will collect such data from relevant third parties.  

Personal Data is shared with members of the John Deere Group (see also section 4, below).  A list of companies belonging to John Deere Group is available here Companies belonging to John Deere Group may jointly process Personal Data in certain circumstances (see also Section 3, below).  

Country or product-specific privacy statements may apply to specific products and services offered by John Deere and these may be accessed in the “Country or Product Specific Information” menu. To illustrate, financial products and services are provided – amongst others- by John Deere Bank S.A. that generally require the collection of additional, or different, categories of information and data.  John Deere GmbH & CO KG also offers a variety of data services and subscriptions.  

Finally, John Deere products are distributed through a network of authorized dealers and distributors.  The majority of these dealers and distributors are independently owned and operated businesses that may have their own privacy statements.

Enterprise Privacy Statement

1. Types of Personal Data Processed

The categories of Personal Data about you that we Process, include as follows:

Personal Details, such as your name, preferred name, surname, nickname, date of birth, username, password and other means of authentication, government identifiers, signatures, and images.

Contact Information, such as address, mailing or postal address, telephone number, social medial profile information, and email address.

Work-Related Information, such as industry, role, business activities, current and former employers, relationship to a customer or third party (e.g., dealership, supplier), work address, work telephone number, work-related social media, and work email address.

Transaction or Financial Account Information, such as billing address, bank account, bank account numbers, and routing numbers; credit or debit card information, security code and expiration date; cardholder or accountholder name and details; instruction records; counterparty information; and information about equipment financing and leasing activities. Where permitted or required by law, we may ask for government issued identification.

Information you may post on message boards, user forms (including social media) or in response to surveys, such as user names, social media profile details, comments (including views and opinions), images, and other information.

Preference and Relationship Information that helps us understand who you are and what you want in order to offer you products and services that may interest you, such as property, farm or business information, your general location, preferences, and language preference. This also includes information about how you interact with us, our dealers and business partners; and details of accounts with us including purchases, inquiries, customer accounts, warranty claims history, and payment history.

Usage Information, such as details about products and services, hardware and operating system specifications, software version, performance data and statistics, log information, usage of devices and applications (and products and services), and diagnostic data.

Automatically Collected Information, such as information about pages or content visited on the Online Services; whether you have opened or read our communications; existence of cookies and other technologies; time and duration of use of the Online Services; and error reports and performance data. Information and data collected include your internet protocol (IP) address (and information related to that IP address); type and version of your device’s operating system or web browser; hardware model, device ID or identifier for any device used to access the Online Services, and other unique device identifiers; and, in some cases, your device’s location. This information may be logged when you use the Online Services.

Sensitive Personal Data: Some of the Personal Data that we may process in connection with the Purposes in Section 2 may be deemed sensitive Personal Data under applicable data protection laws, which (as defined under applicable data protection law) includes data revealing racial or ethnic origin, political opinions, religious or philosophic al beliefs, or trade union membership, and the processing of genetic data, biometric data, data concerning health or data concerning a natural person’s sex life or sexual orientation. Additionally, some personal data may include information concerning criminal convictions and offenses.

2. Sources of Personal Data Processed

We collect Personal Data about you from a variety of sources, including as follows:

Information We Collect Directly from You: Personal Data is generally collected when you provide it to us (electronically, in writing, or verbally). We will ask you for data and information (e.g. Personal Details; Contact Information; Transaction Information) when you interact with us, such as when you sign up for or purchase services or buy products, enter information on our Online Services, register for an account on our Online Services, visit our facilities, sign up to receive a newsletter, contact us for customer service purposes, make a purchase, register for a training class, apply for financing, respond to surveys, register your warranty, or otherwise interact with us. 

Information We Collect Internally: We collect, observe, or learn information about you, such as through your interactions with us (e.g., Preference and Relationship Information); in the ordinary course of our relationship with you; or when you use our products or services (e.g., Information From Usage of Products and Services; Automatically Collected Information). We collect or obtain Personal Data when you visit or use any of our Online Services. We (or third parties) use cookies and other technological tools to collect information about your computer or device and your use of the Online Services (e.g., Automatically Collected Information). For more information about cookies and other technologies, please see the Section 5, “Cookies and Similar Collection Technologies”.

Information Collected From Third Parties: We receive Personal Data about you from third parties who provide it to us, such as members of the John Deere Group, our customers, authorized John Deere dealerships, your employer, credit reference agencies, or law enforcement or governmental authorities (e.g., Personal Details; Contact Information; Work-Related Information; Transaction or Financial Account Information). We also receive Personal Data about you from third parties where you purchase any of our products or services through such third parties (e.g., authorized John Deere dealerships).

Publicly Available Information: We collect Personal Data about you (e.g., Preference and Relationship Information) that is publicly available (e.g., beneficial owner information of a customer, company and business details, financial information) or information you make publicly available; from third party data suppliers, who enhance our files and help us better understand our customers; or from social media sites, such as Facebook, if you interact with a social media function on the Online Services such as a social medial plug-in (a Facebook "like" button), if you ‘like’ our social media pages, or join our communities. If you interact with us through social media, you may permit us to have access to information from your social media profile.

3. Purposes for Processing Personal Data (The "Purposes")

Personal Data is processed for the following Purposes and legal grounds (legal bases for Processing). Where applicable, we will point out, at the time of the data collection, if the provision of the Personal Data is a statutory or contractual requirement and whether you are obliged to provide the Personal Data and the possible consequences of failure to provide such data:
a) Customer Service: To provide requested products and service; for related services such as product delivery, maintenance, customer and product support and service (including warranty service), financing, leasing, and credit services; and operation of the Online Services.

This includes processing Personal Data to: perform tasks necessary to process and fulfill requests or orders, such as responding to requests for additional information or responding to requests for a quote (either directly or through an authorized John Deere dealership), to verify an individual’s identity (or identify of a representative) in order to allow access to a business customer’s account, verify eligibility for incentive programs, process product registrations, and provide requested goods and services (including facilitating order and delivery process between you and an authorized John Deere dealership); activate software and devices that require activation; administer your account(s) and process payments for goods and services; establish and perform contracts; process warranty claims and provide warranty service; provide and service extended warranty programs, including managing service contracts and billing/invoicing; register and establish an account in the Online Services, including user account set up and administration; and provide you the Online Services and its functionalities, including operating and managing the Online Services, providing content to you, and communicating and interacting with you on the Online Services.

The processing is justified based on statutory provisions that (1) the processing is necessary in connection with any contract that you may enter into with us (including Terms of Use regarding the Online Services), or to take steps prior to entering into a contract with us; (2) the processing is necessary to comply with a legal or statutory obligation applicable to us; (3) processing is necessary for the purposes of John Deere, a member of the John Deere Group, or third party’s (e.g., dealership or business customer) legitimate interests in providing you with customer service, product and customer support, training and other educational events, and communicating relevant information about product updates and improvements and product improvements (to the extent that such legitimate interests are not overridden by your interests or fundamental rights and freedoms); or (4) processing is with your consent.

b) Product and Customer Support: To provide support for products and services; manage relationships with customers, dealers, and suppliers; for diagnostics and repairs; communications; and product safety and administering recalls.

As part of providing service and support, we use a customer relationship management system (Personal Details, Contact Information, Preference and Relationship Information, Publicly Available Information) to track engagement, make sure contact information is up-to-date, obtain a comprehensive view of business with you (and your company), avoid duplicating communication on similar topics, provide sales and support, and respond to any communications or requests from you.

This includes processing Personal Data to: provide training and other educational events to customers and customer personnel, dealers and dealer personnel, and suppliers and supplier personnel; provide periodic maintenance and support to products and services (including software updates); respond to requests from dealers for technical assistance in identifying an issue with a product or service and other diagnostics; and provide communications related to your products or services, including service information, confirmations, notices, updates, support and administrative messages, and to provide you with information for safety or legal reasons such as recalls and safety communications.

The processing is justified based on statutory provisions that (1) the processing is necessary in connection with any contract that you may enter into with us (including Terms of Use regarding the Online Services), or to take steps prior to entering into a contract with us; (2) the processing is necessary to comply with a legal or statutory obligation applicable to us (e.g., notifying and managing recalls); (3) processing is necessary for the purposes of John Deere, a member of the John Deere Group, or third party’s (e.g., dealership, business customer) legitimate interests in providing you with customer, product and customer support, training and other educational events, and communicating relevant information about product updates and improvements and product improvements (to the extent that such legitimate interests are not overridden by your interests or fundamental rights and freedoms), or (4) processing is with your consent.

c) Advertising: To provide you with communications and offers for products and services from John Deere, members of the John Deere Group, or our dealers, suppliers and partners, including offers based on your interests, personal and business characteristics, and location.

We (or third parties, such as an authorized John Deere dealership) may provide these communications and offers via email, postal mail, online (including providing advertising and content personalized to you on the Online Services), social media platforms, text message, push notifications, and other means. In connection with marketing on social medial platforms, pseudonymous information (cryptographic hash of Personal Details or Contact Information) can be provided to social media platforms to enable a match to your social media account and allows us to advertise to you on the platform. As discussed in detail in Section 5, we (or third parties) use cookies and other similar technologies to allow us to personalize the Online Services or to place advertisements relevant to your interests on third party websites.

This includes processing Personal Data to: create advertising and marketing programs using information (Personal Details, Contact Information, Preference and Relationship Information, Usage Information, Automatically Collected Information) to suggest products and services in which you may have an interest both online and offline, and use information (Personal Details, Usage Information, Automatically Collected Information) to personalize the Online Services and make the Online Services more relevant to your interests.

The processing is justified based on statutory provisions that (1) processing is necessary for the purpose of John Deere, a member of the John Deere Group, or third party’s (e.g., dealership) legitimate interests in conducting marketing, prospecting, and obtaining new customers, getting to know preferences to better personalize offers, and to offer products and services that meet a ( prospective) customer’s needs (to the extent that such legitimate interests is not overridden by your interests or fundamental rights and freedoms); or (2) processing is with your consent.

d) Surveys & Promotional Events: To administer sweepstakes, contests, loyalty programs, and other promotional events for which you sign-up or enter, such as scheduling and arranging tours of a member of the John Deere Group’s facilities or our attractions, or participating in product introductions and other trade shows.

The processing is justified based on statutory provisions that (1) processing is necessary in connection with any contract that you may enter into with us (including Terms of Use regarding the Promotional Event), or to take steps prior to entering into a contract with us; (2) processing is necessary for the purposes of John Deere or a member of the John Deere Group’s legitimate interests in providing marketing, prospecting, and servicing and obtaining (prospective) customers (to the extent that such legitimate interests is not overridden by your interests or fundamental rights and freedoms); or (3) processing is with your consent.

e) Other Communications: To provide other information that may be of interest, such as announcements, reminders, service outages, product improvement programs, and technical service bulletins; news about John Deere or members of the John Deere Group, company magazines (such as The Furrow and Homestead), and catalogs; and invitations to trade shows, product introductions, and other events.

The processing is justified based on statutory provisions that (1) processing is necessary in connection with any contract that you may enter into with us (including Terms of Use regarding subscriptions to our publications), or to take steps prior to entering into a contract with us; (2) processing is necessary for the purposes of John Deere, a member of the John Deere Group, or third party’s (e.g., dealership) legitimate interests in marketing, prospecting, obtaining new customers, and servicing and communicating news to (prospective) customers such as product updates and improvements and other information about products and services (to the extent that such legitimate interests is not overridden by your interests or fundamental rights and freedoms); or (4) processing is with your consent.

f) Research; Improving Products & Services: To identify and detect issues with existing products and services, understand how our products and services are used, analyze advertising effectiveness, conduct research, improve products and services, and develop new products and services (including using pseudonymized and anonymized information).

This includes processing Personal Data to: measure audience size and customer engagement; send experience surveys, enable participation in online and offline research panels, and analyze responses; assess performance and operation of both production and test products and services (including Usage Information); review trouble codes and other operating data from machines, warranty claims, and technical requests for assistance from dealerships to detect issues with products or services (including safety issues), improve products and services, and develop new products and services; and improve performance, troubleshoot bugs, and to make enhancements to the Online Services (e.g., use browsing information on visits to the Online Services and how you move around the Online Services to make it more intuitive).

The processing is justified based on statutory provisions that (1) processing is necessary in connection with any contract that you may enter into with us (including Terms of Use regarding the Online Services), or to take steps prior to entering into a contract with us; (2) processing is necessary for the purposes of John Deere or a member of the John Deere Group’s legitimate interests in identifying issues with its products and services, conducting research and producing analyses, improving products and services, and developing new products and services (to the extent that such legitimate interests is not override by your interests or fundamental rights and freedoms); (3) processing is necessary in order to protect the vital interests of an individual (e.g., identification of safety issues); (4) processing is necessary to comply with a legal obligation to which we are subject (e.g., product safety; recalls); or (5) processing is with consent.

g) Physical Security: To implement and maintain physical security, manage access to facilities; and review access to facilities in the event of an incident or where needed to investigate unauthorized access, loss or theft.

This includes Processing Personal Data to: create and manage user IDs, badges, keys, and other access management methods to make sure individuals have appropriate permission before accessing John Deere or a member of the John Deere Group’s facilities (i.e., access control and prevention of unauthorized access); and monitor John Deere or a member of the John Deere Group’s facilities (including through the use of closed circuit television and other types of cameras) to protect people, and protect against theft, vandalism and damage to John Deere or a member of the John Deere Group’s property. This also includes Processing records of access to facilities or authorized areas (e.g., recording entrance and exit of individuals) to adequately investigate any unauthorized access, loss or theft.

The processing is justified based on statutory provisions that (1) processing is necessary to comply with a legal obligation to which we are subject; (2) it is necessary in order to protect the vital interests of an individual; (3) it is necessary for purposes of John Deere or a member of the John Deere Group’s legitimate interests to ensure the physical and electronic security of our businesses, premises, and assets (i.e., adequately protect and defend its property (e.g., physical or intellectual property) and to adequately investigate any unauthorized access, loss or theft; and providing for physical security) (to the extent that such legitimate interest is not overridden by your interests or fundamental rights and freedoms). If criminal offenses and convictions-related data are processed such processing occurs in accordance with EU or EEA member state law.

h) Network/Cybersecurity: To provide electronic security (network and cybersecurity), including to identify, protect, detect, respond, and recover from security events.

This includes processing Personal Data to: identify threats, vulnerabilities and risks; identify, authenticate, and determine appropriate authorization of users; issue and revoke credentials; assign and manage user access permissions; prevent and detect the unauthorized access or processing of data and malicious code distribution; stop denial of service attacks and other damage to computer and electronic communications systems; prevent and detect fraud, crime or misuse of IT services; block spam, phishing attempts and computer viruses and other malware; provide product and user security; and prevent unauthorized transmission of proprietary data and other information (e.g., Personal Data).

The organization’s Global Security team located primarily at Deere & Company in Moline, Illinois (but containing individuals located at other members of the John Deere Group), processes Personal Data to assist us in identifying and investigating suspicious incidents or events (including through forensic examination); coordinating a response; and restoring functionality.

The processing is justified based on statutory provisions that (1) processing is necessary because of a need to comply with a legal obligation to which we are subject; (2) it is necessary in order to protect the vital interests of an individual; or (3) it is necessary for purposes of John Deere or a member of the John Deere Group’s legitimate interests to adequately protect and defend its property (e.g., physical or intellectual property); and providing for network and information security (including administrative, technical and organizational measures) (to the extent that such legitimate interest is not overridden by your interests or fundamental rights). If criminal offenses and convictions-related data are processed such processing occurs in accordance with EU or EEA member state law.


i) IT Operations: To manage IT systems, applications, and infrastructure (including monitoring performance of IT systems and infrastructure), perform IT audits, and provide information and communication services.

This includes processing Personal Data to: facilitate communication and use of other IT tools; administer use of John Deere or a member of the John Deere Group’s applications; identify and resolve problems with IT systems and tools; install upgrades and patches; ensure business continuity, including creating backups; and helpdesk management.

The processing is justified based on statutory provisions that it is (1) necessary for the performance of a contract to which you are a party or in order to take steps (at your request) prior to entering into a new contract; and (2) necessary for purposes of John Deere or a member of the John Deere Group’s legitimate interests in managing, maintaining, and operating information communication technology infrastructure (to the extent that such legitimate interest is not overridden by your interests or fundamental rights and freedoms).

j) Business Operations: To manage the day-to-day operations of John Deere and the John Deere Group, for data analysis to report on business performance, and for corporate governance (including audit(s), compliance controls and other risk management activities (including procurement of insurance)).

This includes processing Personal Data for: organizational analysis, development, and management reporting (including modeling and developing risk models); scheduling work and managing our assets; financial account management, including payment processing and managing accounts receivable and payable; tactical and strategic planning; project and organizational management; record retention and archiving; contract management; management of third party relationships (vendors, suppliers, business partners, dealerships); the protection and enforcement of rights; internal and external auditing; reorganization, acquisition, merger, demergers, and divestiture planning and processing; and processing personal data for the purpose of anonymizing/de-identifying.

On behalf of the organization, the John Deere Group jointly administers certain categories of Personal Data (e.g., Personal Details; Contact Information, Usage Information, Preference and Relationship Information, etc.) for concurrent business processes of other members of the John Deere Group including John Deere. The John Deere Group also jointly administers infrastructure where members of the John Deere Group process Personal Data for their own purposes.

The processing is justified based on statutory provisions that (1) it is necessary to comply with legal obligations applicable to us; or (2) it is necessary for purposes of John Deere or a member of the John Deere Group’s legitimate interests to manage and operate the day-to-day operation of John Deere and the John Deere Group, manage financial affairs of John Deere and the John Deere Group, to manage risks to which John Deere and the John Deere Group are exposed, corporate and information governance, evaluation of business transactions, and evaluation of merger and acquisition activity (including due diligence of acquisition targets) (to the extent that such legitimate interest is not overridden by your interests or fundamental rights and freedoms).

k) Eligibility: To determine eligibility for products, services or offers; verify or assist with the verification of your identity; fulfill regulatory compliance obligations; screen against government or other sanction lists; and comply with internal compliance requirements.

This includes Processing Personal Data to: conduct know-your-customer due diligence (including using information from various sources, such as public information, to check and verify identifies); running credit and credit reference checks and risk assessments; screen against sanction lists; and comply with other regulatory requirements (including requirements imposed on other members of the John Deere Group), such as verifying whether you are a politically exposed person and complying with terrorist financing detection and prevention requirements.

The Global Trade Compliance Group located primarily at Deere & Company in Moline, Illinois (but containing individuals located at other members of the John Deere Group), assists John Deere in processing Personal Data for this Purpose. The Global Trade Compliance Group has primary responsibility for identifying and investigating initial matches with individuals on sanctioned party lists, and investigating and clearing incorrect matches.

The processing is justified based on statutory provisions that (1) processing is necessary in connection with any contract that you may enter into with us (including Terms of Use regarding the Online Services), or to take steps prior to entering into a contract with us; (2) processing is necessary to comply with a legal or statutory obligation applicable to us; (3) processing is necessary to protect the vital interests of individuals; (4) processing is necessary for a task carried out in the public interest; or (5) processing is necessary for the purposes of John Deere or a member of the John Deere Group’s legitimate interests in preventing money laundering and sanctions violations, fraud prevention and detection, and understand our (prospective) customers and business partners (to the extent that such legitimate interests is not overridden by your interests or fundamental rights and freedoms); or (4) processing is with your consent. If sensitive personal data is processed it is processed in accordance with EU or EU/EEA member state laws, including where necessary for the establishment, exercise or defense of legal claims. If criminal offenses and convictions-related data are processed such processing occurs in accordance with EU or EEA member state law.

l) Legal Compliance; Proceedings: To comply with applicable laws and regulations; and establishing, exercising, and defending legal rights.

This includes Processing of Personal Data (including sensitive personal data or data related to criminal convictions and offenses) to: comply with legal and other requirements to which members of the John Deere Group are subject (including laws and regulations of countries other than one in which you are located); comply with governmental inspections and other requests from government or other public authorities (including those of countries other than the one in which you are located); respond to legal processes; pursue legal rights and remedies, including to protect and enforce our rights, property our property, protect the rights, property or safety of others, and that of members of the John Deere Group; and investigate, prepare for and defend litigation and managing any internal complaints or claims (including United States-based litigation and government requests).

The processing is justified based on statutory provisions that (1) it is necessary to comply with legal obligations applicable to us; or (2) it is necessary for purposes of John Deere or a member of the John Deere Group’s legitimate interests to manage and operate the day-to-day operation of the business, manage financial affairs of our business, to manage risks to which our business is exposed, corporate and information governance, and compliance with non-EU laws and laws of other countries in which the John Deere Group operates (to the extent that such legitimate interest is not overridden by your interests or fundamental rights and freedoms). If sensitive personal data is processed it is processed in accordance with EU or EU/EEA member state laws, including where necessary for the establishment, exercise or defense of legal claims. If criminal offenses and convictions-related data are processed such processing occurs in accordance with EU or EEA member state law.

m) Investigations: To prevent, detect, and investigate fraud, breaches of corporate policy or other unauthorized, infringing, or improper activity (including criminal offenses).

This includes processing Personal Data to: investigate and respond to compliance cases and hotline submissions (including operation of a reporting line pursuant to the U.S. Sarbanes-Oxley Act).

Concerning compliance investigations, the John Deere Group’s Center for Global Business Conduct and Global Enterprise Security & Preparedness primarily located at Deere & Company in Moline, Illinois (with individuals located at other members of the John Deere Group), oversee and assist John Deere.

The processing is justified based on statutory provisions that (1) it is necessary to comply with legal obligations applicable to our business; or (2) it is necessary for purposes of John Deere or a member of the John Deere Group’s legitimate interests to manage and operate John Deere or the John Deere Group’s business, to manage risks to which John Deere or the John Deere Group are exposed, corporate and information governance, detecting and preventing fraud; detecting and preventing breaches of John Deere Group policies, and compliance with non-EU laws and laws of other countries in which the John Deere Group operates (to the extent that such legitimate interest is not overridden by your interests or fundamental rights and freedoms). If sensitive personal data is processed it is processed in accordance with EU or EU/EEA member state laws. If criminal offenses and convictions-related data are processed such processing occurs in accordance with EU or EEA member state law.

4. Recipients of Personal Data

a) Personal Data is shared or disclosed within John Deere and to members of the John Deere Group for the purposes described in this Statement. Members of the John Deere Group will process Personal Data in accordance with this Statement unless they have informed you otherwise.

b) To achieve the purposes in Section 3, we share or disclose Personal Data within the John Deere Group. We leverage the competence and knowledge of the John Deere Group, such as centralized HR, accounting, treasury, risk management, corporate governance, information technology, and security functions. References to John Deere and members of the John Deere Group in Section 3 of this Statement generally refer to instances where members of the John Deere Group act as joint controllers, together with John Deere.

c) We disclose Personal Data if necessary to complete any transaction you have requested or authorized, or provide you a product or service.

For example, providing payment data to banks and other financial institutions to process a payment. We will also share data when you direct us to. You may also request additional information about a product or service, or request a quote on the Online Services, that we send to the authorized John Deere dealership in your area for follow-up to satisfy your request. As outlined in Section 12, you can also share reviews and feedback on forums and other public areas.

d) We share or disclose Personal Data with authorized John Deere dealers, distributors, merchants, and business partners, in connection with the Purposes listed in Section 3.

For example, an authorized John Deere dealership liaises between you and us concerning the administration of your relationship with John Deere, including assistance with obtaining quotes, purchase of equipment or services, ordering parts, managing products and services (including subscriptions), financing, and warranty service.

e) If you are an employee or representative of a customer or a dealer, we share or disclose data to such customer or dealer.

f) We share Personal Data with third party service providers (commonly referred to as ‘data processors’) to fulfill the purposes on our behalf.
For example, technology companies such as companies who provide software and computing services (e.g., data management and storage services, hosting companies, software-as-a-service, web-hosting, and email services); technology companies who provide hardware and equipment (e.g., manufacturers and distributors of computers); support services such as companies that provide business support services (e.g., mailing vendors, printing services, office cleaning, and companies that install, service and monitor alarm systems); companies that provide financial administration; companies that provide waste & disposal services (e.g., shredding provider); and analytics providers. In some cases, these companies may collect data directly from you on our behalf.

g) We also share or disclose Personal Data with other companies to perform specialized or professional functions for us (commonly referred to as ‘data controllers’).

For example, financial institutions such as payment processors and banks involved in processing payments or providing us with financing; financial institutions such as insurance brokers and insurance companies who assist us in managing our risk; support services such as business support companies and companies who provide training courses; shipping companies who deliver our products; telecommunications companies who provide fixed line and mobile telecommunications services; technology companies that provide technology and hardware such as telecommunications equipment; health care equipment and services companies such as health providers who provide medical services; and other parties (such as legal and regulatory authorities, accountants, auditors, lawyers and other outside professional advisors) to support auditing, compliance, and corporate governance functions and/or in accordance with the law.

h) The Online Services contain plugins or third party content, such as Facebook (the “like” button), Twitter (“Share to Twitter” button), Linkedin, or Google. Plugins or content may collect your IP address; page(s) visited on the Online Services; and may use their own cookies and similar technologies. If you are logged in to a social media website while visiting the Online Services the social media plugins may allow the social media website to receive information that you visited the Online Services and link it to your social media account.

For example, the Online Services use Google Maps. By using Google Maps, you are bound by the Google Maps/Google Earth Additional Terms of Service (including the Google Privacy Policy).

i) We also share or disclose Personal Data for legal, compliance, governance, or litigation purposes.

For example:

  • We share or disclose Personal Data to buyers, their lawyers or professional advisors, courts, tribunals, opposing or related parties to the proceedings and their professional advisors, where needed to affect the sale or transfer of all or part of John Deere’s business or assets (including a reorganization, merger, sale, joint venture, dissolution, liquidation, or bankruptcy).
  • We share or disclose Personal Data to protect and enforce our rights, protect our property, protect the rights, property or safety of others, and that of members of the John Deere Group, protect against fraud or other unlawful acts, for prevention, investigation, detection or prosecution of criminal offenses, or as otherwise needed to support external auditing, compliance, and corporate governance functions.
  • We will also share or disclose Personal Data where required to do so by law (including laws outside the country in which you are located), such as in response to a subpoena, search warrants, court orders, and other legal process, including to law enforcement agencies, tribunals and courts in the United States and other countries where members of the John Deere Group operate.
  • Please note that we may also share and disclose information and data about you that is not Personal Data. For example, we may publish reports that contain aggregated and statistical data about our customers and equipment. 

5. Cookies and Similar Collection Technologies

When you visit the Online Services or open or click a communication such as an email from John Deere, John Deere (or third parties) collect information and data by automated means, using technologies such as server or usage logs, browser or http cookies, local shared objects, local storage, web beacons/pixel tags, embedded scripts, ETags, server-to-server connections, and other similar collection technologies.

These technologies are used, generally, to enable the proper operation of the Online Services, remember your preferences or choices, assist in the improvement of the Online Services, measure responses to our communications, improve our communications or promotions, provide a customized or personalized experience on the Online Services, detect and prevent certain kinds of fraud, and to deliver relevant advertisements. In some cases, we do associate information we collect using cookies and similar collection technologies with other Personal Data collected about you as outlined in Section 3 of this Statement.

We have relationships with third parties to perform tracking and reporting functions for our web processing. We also have relationships with third parties to help us deliver personalized content and relevant advertisements on the Online Services or on third party sites and services you may visit. These third parties may use cookies and other similar collection technologies to collect information about your use of the Online Services and your activities on third party sites and services so that they can display targeted advertisements to you.

6. Tell-A-Friend Functions

John Deere offers "tell-a-friend" functionality on our websites. If you choose to use this function, we will automatically send your friend a one-time email with the information you specified and invite him or her to visit the website. John Deere uses this information for the sole purpose of sending this one-time email and does not retain the information.

7. Data Subject Rights

Subject to local law, you may exercise certain rights regarding personal data free of charge: (a) Access: You have the right to obtain from us confirmation if personal data is being processed, the purpose of processing, the categories of data, information on recipients of the data and the non-EU countries in which they are located, the safeguards put in place for the transfer of data to non-EU countries, storage period of data or criteria to determine it, further information on your rights, our processing activities and data providers, and the significant and envisaged consequences of processing; (b) Rectification: You have the right the request the rectification of inaccurate personal data and to have incomplete data be completed; (c) Portability: You may receive personal data about you that you have provided to us, in a structured, commonly used and machine-readable format and have the right to transmit it to other data controllers without hindrance. This right only exists if the processing is based on your consent or a contract and the processing is carried out by automated means; (d) Restriction: You may request to restrict processing of personal data about you if (i) you contest the accuracy of it – for a period we need to verify your request; (ii) the processing is unlawful and you oppose the erasure of it and request restriction instead; (iii) we no longer need it, but you tell us you need it to establish, exercise or defend a legal claim; or (iv) you object to processing based on public or legitimate interest – for a period we need to verify your request; and (e) Erasure: You may request to erase personal data about you if it is no longer necessary for the purposes for which we have collected it, you have withdrawn your consent and no other legal ground for the processing exists, you objected and no overriding legitimate grounds for the processing exist, Processing is unlawful, or erasure is required to comply with a legal obligation.

Objection: You have the right to object to the processing of personal data about you for compelling and legitimate reasons relating to your particular situation, except in cases where legal provisions expressly provide for that processing. In addition, you have the right to object if data about you is processed for direct marketing purposes.

8. Consent Management

If we have asked you to provide your consent to use Personal Data for a specific purpose you may refuse to give consent and withdraw your consent at any time, including by contacting us using the methods outlined in Section 7 or 15. The lawfulness of any processing of Personal Data that occurred prior to the withdrawal of your consent will not be affected. 

9. Transfer of Personal Data to Other Countries

Due to the global nature of our operations, some of the recipients mentioned in Section 4 may be located in countries outside the European Economic Area (EEA), which do not provide an adequate level of data protection. International transfers will be to countries where members of the John Deere Group have offices, including India and the United States of America.

Some non-EEA countries are recognized by the European Commission as providing an adequate level of data protection according to EEA standards (a list of such countries is available here: http://ec.europa.eu/justice/data-protection/international-transfers/adequacy/index_en.htm  For transfers from the EEA to countries not considered adequate by the European Commission, we will put in place adequate measures, such as binding corporate rules, standard contractual clauses adopted by the European Commission to protect Personal Data, other valid transfer mechanism(s), or, in exceptional circumstances, on the basis of permissible statutory derogations. Transfers to third parties located in such countries will take place using an acceptable data transfer mechanism, such as binding corporate rules, Privacy Shield to self-certified US organizations, standard contractual clauses adopted by the European Commission to protect Personal Data, certifications, approved codes of conduct, other valid transfer mechanism, or, in exceptional circumstances, on the basis of permissible statutory derogations. 10. Data Retention

Data will be retained for the period we consider necessary for completion of the purposes indicated in this Statement or as required by applicable law. The criteria for determining the period of retention include:  

  • We have an ongoing relationship with you;
  • Personal Data are required for the Purpose(s) listed in Section 3; or
  • Applicable laws and regulations require us to keep Personal Data.

We may also be required to keep personal data for a longer period of time, such as in the event of litigation or if we receive a subpoena, search warrant, court order, or other legal process that requires us to keep the personal data. Data is retained in accordance with our record retention schedule and with applicable legal provisions. Subject to our record retention schedule and with applicable legal requirements, we will delete and/or anonymize Personal Data that are no longer needed.
